Ticketpro is a private company registered in the Republic of South Africa, which, through its various subsidiaries, divisions and brands*(https://www.ticketpros.co.za/portal/web/index.php) conducts the business (“Business”) of promotion, marketing and sale of various products and services (together herein referred to as “Products”) to consumers on behalf of relevant suppliers (“Suppliers”) and the management and facilitation of customer relationships in respect of such Products via its platforms and websites, being www.ticketpros.co.za , www.ticketprotravel.co.za and www.smarttap.co.za [“Websites”] (“Services”).

The Business is conducted using various methods and channels, including onsite, via premises of third parties    appointed      by      Ticketpro     (“Strategic      Partners”)     (https://www.ticketpros.co.za/portal/web/index.php/outlets/) as outlets (“Distribution Outlet”) and directly to the public via the Websites, Internet, retail partners, SMS, telephone, E-mail, landing pages, social media platforms, social media sites and other means (together referred to as “Distribution Channels”).

This Privacy Policy applies to each Distribution Channel through which Products and Services are sold and/ or provided.

“Ticketpro”/ “we”/ “us” or “our” includes each business unit, division, branch and/or representative office of any business of Ticketpro, and any of Ticketpro’s associates, cessionaries, delegates or successors in title or duly appointed third parties such as its authorised agents, advisors, partners, service providers and contractors.

We are a subsidiary of Blue Label Telecoms Limited, Registration No 2006/022679/06 (“BLT”).

BLT has established a central data processing structure for all entities and affiliates forming part of the BLT Group of companies ("BLT Group") and Personal Information processed by us will form part of the data of the BLT Group as a whole and may be used by the BLT Group for the purposes contained in this Privacy Policy. This Privacy Policy will apply to such processing.

As such, “Ticketpro”/ “we”/ “us” or “our” also includes the companies making up the BLT Group from time to time, including, any holding companies or subsidiaries of BLT Group companies or companies connected to the BLT Group; and any associates, cessionaries, delegates or successors in title or duly appointed third parties such as authorised agents, advisors, partners, service providers and contractors of members of the BLT Group.

This Privacy Policy has been published to help you understand our privacy practices by describing how we collect and use your personal information, why we collect it, with whom we share it, and your choices and rights in relation to your personal information. Except as set in this Privacy Policy, we do not share, or sell, or disclose, any personal information collected.

Our Privacy Policy has been developed to provide a framework for the appropriate level of privacy protection and represents our commitment to compliance with South African data protection legislation and any other applicable worldwide data protection laws, to try and achieve the highest standards in protecting your personal information.

This Privacy Policy applies to Personal Information that we collect from you during any of your communications, interactions and transactions with us, including through any Distribution Channels that link or refer to this Privacy Policy or to personal information that we collect and/or receive from third parties as explained below.

By submitting your details to us or visiting or using any of the Distribution Channels you accept the application of this Privacy Notice and updates thereto and expressly consent to the processing of your personal information in the way described herein.

This Privacy Policy will also apply to personal information held on our database of existing customers (“customer database”). Existing customers on our customer database may request to be removed from the customer database or opt-out of our Services at any time by giving written notice as more fully explained below.

Personal information is defined in POPIA as information relating to an identifiable, living, natural person, and where it is applicable, an identifiable, existing juristic person, and includes any information that identifies or relates specifically to you, including, for example, your name, age and identity number or other national identifier, your contact address, your location, your banking details, e mail and contact numbers. In short, personal information refers to any information that identifies a person or specifically relates to a person.

Some types of personal information are considered special personal information. These include personal information revealing or related to a person’s health, racial or ethnic origin, religious or philosophical beliefs, sex life, political affiliation, or trade union membership; criminal behaviour and proceedings related thereto.

When will we process your Personal Information

We will only process Personal Information for lawful purposes relating to our business in any one or more of the following circumstances:

you are an existing customer on our customer database. This means you have purchased a Product from us or used our Services;

where you communicate, interact and/ or transact with us, our Strategic Partners and/ or Suppliers;

where your personal information is held by another member in the BLT Group and you have agreed to the processing thereof by members of the BLT Group;

if, where required, you have consented thereto;

if you have not requested that we refrain from processing your personal information;

When will we process your Special Personal Information

We may process your special personal information in any one or more of the following circumstances:

if the processing is needed to create, use or protect a right or obligation in law;

if the processing is for statistical or research purposes and all legal conditions are met;

if the special Personal Information was made public by you;

What categories of Personal Information we collect

location or geolocation information of your device that you use, if your device settings allow us to collect location information;

device and browsing information and other Internet activity information, including information about your phone, tablet, computer, or device, and online browsing activity (collectively, "automatically collected information"). Automatically collected information may include IP addresses, unique device identifiers, cookie identifiers, device and browser settings and information, and Internet service provider information. Automatically collected information also may include information about when and how you access and use the Distribution Channels or how you interact with us on the Distribution Channels, such as the date and time of your visit or use, the websites you visit before coming and after leaving our Distribution Channels, how you navigate and what you search for using our Distribution Channels, the website pages and items you view using our Website and other Distribution Channels, and the items you purchase or offers you show an interest in; and

However, if this personal information is necessary to provide you with Services and Products and / or offers for the aforesaid, access to our Distribution Channels, or to perform administrative functions, we may be unable to do these things.

When and where we obtain Personal Information about you

We may collect personal information about you from various different sources, including the following:

From and based on your access to and/ or use of our Services or Distribution Channels.

From your completed applications and/ or registration for Products and/or Services;

From and based on your purchase of an NFC chip and your interactions with vendors at an NFC event and your use of NFC Services.

From and based on your purchase of any Products and/ or use of any Services.

From and based on your engagement or interactions with Suppliers, Strategic Partners and/ or any other third party duly appointed by us.

From and based on your engagement or interaction with a member of the BLT Group, where you have consented to members of the BLT Group processing that information as Group Data.

From and based on how you engage or interact with us on any platform such as on social media, emails, letters, telephone calls, surveys, competitions.

From public domain sources and third parties

Public domain (like CIPC) and from third parties we interact with for the purposes of conducting our Business, providing the Products and/ or Services and or administering and/ or operating the Distribution Channels (like partners, reward partners, list providers, our customer loyalty rewards programmes’ retail and online partners).

If the law requires us to do so, we will ask for your consent before collecting personal information about you from third parties.

The third parties from whom we may collect Personal Information include, but are not limited to the following:

our Affiliates and members of the BLT Group, for any of the purposes identified in this Privacy Policy;

spouses, dependents, partners, employers, joint account holders and other similar sources;

people you have authorised to share personal information;

attorneys, tracing agents, debt collectors and other persons that assist with the enforcement of agreements;

payment processing services providers, merchants, banks and other persons that assist with the processing of your payment instructions, like card scheme providers (e.g., VISA or MasterCard);

law enforcement and fraud prevention agencies and other persons tasked with the prevention and prosecution of crime;

regulatory authorities, industry ombudsman, governmental departments, local and international tax authorities;

credit bureau and other similar verification agencies;

trustees, Executors or Curators appointed by a court of law;

our Clients, Strategic Partners, Service Providers, agents and sub-contractors like couriers, technology agents and other persons we use to facilitate the Business operation and/ or offer and provide Products and Services;

Strategic Partners and/ or Service Providers participating in customer loyalty reward programmes;

duly appointed and trusted marketing list and lead providers.

Personal information is automatically collected in relation to your visit and use of the Website and App. Such information includes but is not limited to: your browser type and version, as well as your operating system, the type of mobile device you use, your mobile device’s unique device ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browsers you use, and information about the way you use the App and/or the Website.

Ticketpro

THE USE OF THIS TICKET IS SUBJECT TO THE TERMS AND CONDITIONS SET OUT BELOW.

    Right of admission is reserved at the discretion of The Sharks (Pty) Ltd and its senior management.

    This ticket must be produced at appropriate entry points and/or on demand by any authorised official.

    Entry into the stadium and demarcated areas will not be allowed to persons under the influence of alcohol or narcotics or in possession of any item or substance deemed to be illegal or undesirable by the management including any recording equipment and/or dangerous items, weapons, explosives, incendiary devices or sharp objects, animals, or any other items which the management may refuse at their discretion, including any objects or clothing containing political or commercial identification in breach of condition 7 below, or any other object which may be offensive, disruptive, dangerous or likely to infringe the safety or security of others - a full list of which is displayed at the entry points of the stadium which also may be viewed at/or may be obtained from the offices of The Sharks (Pty) Ltd by calling (031) 308 8400.

    Where admission is refused or the bearer is evicted from the stadium and/or demarcated areas, no refund will be paid.

    Access to the playing field for sports events shall be restricted to authorised players and officials on the day of the match to which this ticket refers (the match).

    The bearer shall not behave in a disruptive or drunken manner, endanger the safety of other persons in the stadium and/or demarcated areas, nor unreasonably obstruct the viewing of other spectators.

    The bearer shall not engage in any form of ambush marketing or unauthorised promotions and shall not breach or infringe the rights of any sponsors, suppliers, broadcasters or other parties commercially associated with the match.

    The use of tickets may not be transferred as prizes in lotteries or competitions, sold, donated or disposed of for commercial gain, unless authorised by The Sharks (Pty) Ltd in writing or through an authorized agent. Any ticket obtained in breach of these conditions shall be void and all rights connected therewith shall be nullified including the bearer's refusal of entry to, or eviction from, the stadium and demarcated areas.

    Management shall, subject to these terms and conditions, use its best endeavours to ensure that the bearer be given full and unencumbered use of the seats to which the ticket refers, but reserves the right to substitute the seat with another at its discretion. Management does not guarantee the quality of the match, nor that the bearer will have an uninterrupted and/or uninhibited view of the match from the seat provided.

    Under no circumstance will any refund be given.

    The Scholar Zone tickets are all unreserved seating.

    This ticket is not valid for entry at club venues.

    This ticket is valid for HOLLYWOODBETS KINGS PARK.

    The Sharks (Pty) Ltd will not accept liability for replacement in the event of this ticket being lost/stolen. However, should the decision be taken to replace lost/stolen tickets a pro rata charge will be levied.

    The Sharks (Pty) Ltd, and its employees and agents shall not be liable for any loss, injury or damage howsoever caused to holder of this ticket.

    The Sharks (Pty) Ltd shall be entitled to make rules or change them, or general applicability governing the conduct of spectators, whilst in or around the stadium and including rules of conduct pertaining to the use of the outer fields within the Kings Park complex.

    No person shall be permitted to film or otherwise record any portion of the match or event unless otherwise expressly permitted to do so in writing by The Sharks (Pty) Ltd prior to any filming/recording. Any filming or recording taken by any person shall be the sole property of The Sharks (Pty) Ltd, or any of its broadcasting partners as the case may be.

    This ticket is issued to the Terms and Conditions of sale or issue. By using this ticket you acknowledge that you have read such terms and conditions and undertake to abide by them. The decision of The Sharks (Pty) Ltd is final.

THE SHARKS (PTY) LIMITED THE PROTECTION OF PERSONAL INFORMATION ACT PRIVACY NOTICE

This Privacy Notice applies to you as a customer, fan or as a guest and explains in detail the types of personal data we may collect about you when you interact with us. It also explains how we’ll store and handle that data and keep it safe.

There’s a lot of information here, but we want you to be fully informed about your rights, and how The Sharks uses your data; for example, we will explain how we analyse and combine all the data we hold about you to ensure communications are personalised and relevant.

This privacy notice applies to you as a fan or as a guest, namely a person who accesses or registers on our platforms, regardless of the device which you use to access it (e.g., a computer, mobile phone, tablet etc).

Our website and app are designed to allow fans of The Sharks (“Sharks” “we” or “us”) to interact with the club. We use your personal data in various ways to facilitate this.

The Shark’s use of your personal data allows us to provide products, tickets, and services that you have purchased, to communicate with our fans, to provide you with information about us and about our products, services and events and may also include, where we are allowed to do so, contacting you about products and services and events that we think you’ll be interested in.

Our privacy notice describes how The Sharks will make use of your personal information when you visit our website or app, when we communicate with you and when you buy tickets or products from us.

3. What personal information do we collect and why?

Personal information refers to information about you, such as your name and surname, gender, age, date of birth, contact details (phone number and email) and address, physical location, ID number and your image.

To contact you in order for us to manage, administer and provide our products and services to you.

To respond to any correspondence and service-related enquiries you send to us in respect of our products or services.

To provide you with the latest relevant information such as operational updates (including access information, ticketing information and fixture changes) relating to match days and other events.

We will use this information to market products and services to you where you have consented to this.

We will also use this information to market Shark’s products and services to you (including via electronic means) and to inform you about The Sharks news, competitions, events and other information, to the extent you have not opted-out and to the extent such marketing relates to a product and/or service you have previously ordered or purchased or to a product or service you are communicating with us or have expressed an interest in.

We may use this information to collect payment of debts from you, for example where payments for suite leases are due and owing.

To invite you to give us feedback and/or take part in market research or surveys to assist us with improving our fan or customer experiences and our products and services.

4. How we collect your personal information

We collect your personal information in three ways, namely:

passively from your device when you use our platforms; and

passively from companies in The Sharks Group of companies (our “affiliates”) and third-party service providers.

4.1 Active collection of personal information

Some areas of our site may require you to submit certain information in order for you to register for certain services or benefit from specified features, such as when you register on our platforms, request to receive any newsletters or similar subscriptions or tips/pointers, or participate in a particular activity, such as a game, promotional competition or other promotion (collectively referred to as the “value added services”). If you contact us, we may keep a record of that correspondence.

If you want to take advantage of any of our site sharing features, we will ask you to create a publicly visible profile, indicating, for example, your username and e-mail address.

Our site may also collect personal information from you by asking you specific questions and by permitting you to communicate directly with us, for example via e-mail, feedback forms, site comments and forums.

We passively collect some of your personal information from the device which you use to access and navigate through our platform(s), using various technological means.

One of the keyways in which we collect information passively is using server logs to collect and maintain log information.

4.3 Passive collection of personal information from our affiliates and third-party service providers

We collect some personal information passively from our affiliates and third-party service providers, purely to supplement information which you have already agreed to give us thereby enhancing your fan experience on all of our platforms.

5. How long do we keep your personal information for?

We retain all personal information which we collect from you (except for the information referred to below) unless there is a valid technical, legal or business reason for us to delete, destroy or de identify it (“retained information”).

We will not retain the following information if you ask us not to –

the content of your public communications via our site with site users or third parties for as long as the relevant site feature remains active.

We may keep all retained information for as long as you continue to access our site and for three (3) years thereafter:

Notwithstanding the above, and any other provision of this privacy notice, we may keep some or all your personal information if and for as long as:

This Privacy Notice gives effect to many of our responsibilities as a responsible party in terms of the applicable legislation in the respective countries where we operate.
